PashtoScoop Terms of Use and User Agreement

These Terms of Use (collectively with PashtoScoop, Inc.’s Privacy Policy and DMCA Copyright Policy) govern your use of PashtoScoop’s websites, mobile applications and services such as software, data feeds, email newsletters and associated services provided to you on, from, or through such websites and mobile applications(“Products”) and content appearing in the Producsts (“Content”), and our affiliated publications (together with the site, the “Services”).
This User Agreement set fort a legal and binding agreement between you and PashtoScoop Inc. (“PashtoScoop”, “we”, “us” or “our” hereinafter).
Acceptance of User Agreement
- By registering for and/or using, accessing or contributing to the Services, including but not limited to visiting or browsing the Site, you agree to this User Agreement and all other operating rules, policies and procedures that may be published from time to time on the Site by us, each of which is incorporated by reference and each of which may be updated from time to time without notice to you.
- Certain areas of the Services may be subject to additional terms and conditions specified by us from time to time; your use of such Services is subject to those additional terms and conditions, which are incorporated into this User Agreement by this reference.
- This User Agreement applies to all users of the Services, including, without limitation, users who are contributors of content, information, and other materials or services, registered or otherwise.
Eligibility
If you are below the age of consent under applicable law in the country in which you reside, then your parent or legal guardian must read and accept the terms and conditions of this User Agreement in your name and on your behalf.
By accessing and using the Services, you represent and warrant that you are at least 13 years of age. Please cease your use of our services immediately. We will not knowingly collect information from anyone under the age of 13. If you are a minor, you may wish to consult your parents about what portions of the site are appropriate for you.
You are solely responsible for ensuring that your use of the Services is in compliance with all laws, rules and regulations applicable to you.
The right to access the Services is revoked where this User Agreement or use of the Services is prohibited or to the extent offering, sale or provision of the Services conflicts with any applicable law, rule or regulation. We may, in our sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time.
Content
Definition: For purposes of this User Agreement, the term “Content” includes, without limitation, information, data, text, logos, photographs, videos, audio clips, animations, written posts, articles, comments, software, scripts, graphics, themes and interactive features generated, provided or otherwise made accessible on or through the Services, including the User Content (as defined below).
User Content: All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively “User Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. You represent that all User Content provided by you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations. We do not guarantee that any Content you access on or through the Services is or will continue to be accurate.
Further, you acknowledge that you will be solely responsible for any damage or loss to you or any other party resulting Content provided by you.
Intellectual Property Rights: The Services may contain Content specifically provided by us, our partners or our users and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by all copyright notices, information, and restrictions contained in any Content accessed through the Services.
Use License: Unless otherwise stated, PashtoScoop and/or it’s licensors own the intellectual property rights for material on PashtoScoop. All intellectual property rights are reserved.
Subject to this User Agreement, we grant each user of the Services a worldwide, non-exclusive, revocable, and non-transferable license to view, print, download, and display locally Content, to the extent we hold such rights, solely for purposes of using the Services.
Without prior written permission from us, you must not:
- Store, modigy or exploit any Content from PashtoScoop for commercial use or in any way that violates any third party right.
- Sell, rent or sub-license material from https://pashtoscoop.com
- Reproduce, duplicate, copy or republish material from https://pashtoscoop.com
- Redistribute content from PashtoScoop (unless content is specifically made for redistribution).
License Grant: Some features of the Services may allow you to create, submit, post, embed or display the Content on or through the Services (“User Content”). By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content.
You also waive any right to inspect or approve any final product. We may modify or adapt your User Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your User Content as are necessary to conform and adapt it to any requirements or limitations of any networks, devices, services or media. You understand that your User Content may be syndicated, broadcast, distributed, or published by our partners.
By submitting or posting the User Content, you represent and warrant that you have full and unrestricted rights, power and authority necessary to grant the rights granted herein to any User Content that you submit. By submitting or posting the User Content, you agree that your submission of the User Content does not in any way implicate you as our employee, agent or partner. if you do not have the right to submit User Content for such use, it may subject you to liability. We will not be responsible or liable for any use of your User Content by us in accordance with these Terms.
We will make reasonable efforts to keep the Services operational. However, certain technical difficulties, routine site maintenance, upgrades and other events outside our control may, from time to time, result in temporary service interruptions.
We also reserve the right to modify, suspend or discontinue, temporarily or permanently, the Services or any part thereof with or without notice. You agree that we shall not be liable to you or any third party for any of the direct or indirect consequences of any modification, suspension, discontinuance of or interruption to the Services.
Content Liability
We shall have no responsibility or liability for any content appearing on your Web site. You agree to and defend us against all claims arising out of or based upon your Website. No link(s) may appear on any on your Web site or within any context containing content or materials that may be interpreted as, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or violation of, any third party rights.
Miscellaneous
Termination/Cancellation
We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, licenses of User Content, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Entire Agreement and Severability.
This User Agreement is the entire agreement between you and us with respect to the Services, including use of the Site, and supersedes all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and us with respect to the Services. If any provision of this User Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this User Agreement will otherwise remain in full force and effect and enforceable.
Force Majeure.
We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.
Changes to this agreement
We reserve the right to revise this Agreement at our sole discretion without prior notice and at any time. The latest Agreement will be posted here. By continuing to use the Services after changes are made, you agree to be bound by the revised Agreement.
